Applicants have filed this application under Section 447 B.N.S.S. seeking transfer of Case No. 527 of 2021, titled State Vs. Ankul and others, arising out of Case Crime No. 504 of 2020, under Sections 498-A, 323, 506 I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station Sadar Bazar, District Saharanpur, pending before the Civil Judge (J.D.), Saharanpur to the other court of competent jurisdiction at Saharanpur. Applicant-Complainant has prayed for transfer of the subject trial on the sole ground that the close relatives of the accused- opposite party nos.2 to 6 are practicing advocates at Saharanpur, who are pressuring the complainant to withdraw the case. Considering the ground raised for transfer of the subject trial, this Court does not find any merit in it as the prosecution of the accused is founded upon the police report and the complainant- wife is at best a prosecution witness. That apart, merely because the close relatives of accused are practicing advocate at Saharanpur that alone would not be a sufficient ground for transfer of the case. The application is dismissed.
