THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING THIS DAY, ORDER WAS MADE THEREIN AS UNDER: ORAL ORDER (PER: THE HON'BLE MR. JUSTICE SURAJ GOVINDARAJ) 1. The petitioner is before this Court seeking for the following reliefs: a) Issue WRIT or order or direction in the nature of certiorari by quashing the order dated 27.06.2025 passed in Crl.Misc.No.183/2024 pending on the file of Prl. Family Court, at Ballari, vide Annexure-E in the interest of justice and equity. b) Pass such other order or direction that is deemed fit in the interest of justice and equity. 2. The family Court Ballari in Criminal Miscellaneous Case No.183/2024, had awarded interim maintenance of Rs.20,000/- payable to respondents No.1 to 3, who are the wife and two minor children of the petitioner. - 3 - HC-KAR NC: 2025:KHC-D:10332 WP No. 105712 of 2025 3. The petitioner's father is stated to be running a transport business, owning three buses. However, learned counsel for the petitioner submits that the petitioner does not own the buses, but that they are owned by his father. I am of the considered opinion that the petitioner is working with his father in the transport business, the relationship between the father and the son not being strained. The order directing payment of Rs.20,000/- maintenance per month for the two minor children and the wife is not excessive. 4. Of course, the aspect of permanent maintenance and/or alimony would have to be decided by the trial Court after the trial is conducted. At this juncture, I do not find the maintenance amount ordered to be excessive so as to require interference by this Court. As such, the petition stands dismissed.
