Challenge in this petition is to the order dated 17.01.2025, passed by learned Sessions Judge, Katghora, Distt -Korba, (C.G.), in Criminal Appeal No.29/2024, (Annexure A-1) whereby the appeal preferred by the applicant/juvenile against the order of Juvenile Justice Board, Korba, dated 28.08.2024, has been dismissed and applicant has been denied bail. Case of prosecution, in brief, is that father of prosecutrix/victim lodged missing report to the concerned Police Station, based upon which, FIR was registered initially against known persons. During course of investigation, prosecutrix was recovered and her statement was recorded under Section 161 of Cr.P.C, based upon which, applicant was arrested in aforementioned crime. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case and no offence has been committed by him and he is minor, therefore, the applicant may be enlarged on bail. 4. Learned State Counsel opposes the submission made by counsel for the applicant would submit that there is specific allegation against the applicant of committing the alleged offence/crime with minor victim aged about 11 years. She further pointed out that social status report is also against the present applicant. Hence, looking the nature of offence, applicant may not be released on bail. 5. Heard learned counsel for the parties. 6. Father and mother of victim are present before this Court and raised strong objection in granting bail to the applicant. 7. While dismissing the appeal of the applicant, learned Session Judge observed as under: “7. ्ቚकरण में किकशोर न्याय बो्ቑ कोरबा के ्ቛारा किधि किरू्ቍ संघ्ቧरत बालक का सामजिक पृ्቗भूकिम रिरपो्቏ ्ቚा्቎ किकया गया है, जिसमें किधि किरू्ቍ संघ्ቧरत बालक को शराब का सेन करना Page No.3 बताया गया है तथा उसके माता किपता की उपे्ቌा अथा अधिक संर्ቌण एं हम उ्቞ ्ቇुप के ्ቚभा में तथाकथिथत अपरा किकया ाना और उसका कारण माता किपता की उपे्ቌा बताया गया है। किधिक सह परिरकि्ቌा अधिकारी ्ቛारा कि8ये गये सामाजिक अन्े्ቧण रिरपो्቏ अंतगत यह ्ቚधितेकि8त किकया गया है किक मानत आे8न स्ीकार किकये ाने से किधि किरू्ቍ संघ्ቧरत बालक के बुरे संगत में आने की संभाना है और उसमें सुार हेतु उसे सुरधि्ቌत स्थान पर रखा ाना उधि<त 8ቦኌशत है। उ्ሹ ्ቚधिते8न अंतगत किधि किरू्ቍ संघ्ቧरत बालक के उधि<त 8ेखरेख एं संर्ቌण के अभा के कारण ही उसके आगे की पढ़ाई नहीं हो सकना भी ्ቚधितेकि8त किकया गया है। इस ्ቚकार सामाजिक रिरपो्቏ के आार पर यह दृकिDगत है किक किधि किरू्ቍ संघ्ቧरत बालक को सुरधि्ቌत अथिभर्ቌा में रखा ाना उसके सE्ቈम किहत में है और ऐसा ही किकशोर न्याय बो्ቑ ्ቛारा मानत आे8न प्ቔ अनुसार किनराकृ त किकया गया है। 8. अतः उपरो्ሹ 8ቦኌशत कारण उ्ሹ समस्त तथ्यों के ्ቚकाश में किकशोर न्याय बो्ቑ ्ቛारा पारिरत आ8ेश कि8नांक 28.08.2024 में कोई किधिक ्ቔुकि्቏ या हस्त्ቌेप का कारण 8ቦኌशत नहीं हुआ है। अतः ्ቚस्तुत अपीलाथL की ओर से ्ቚस्तुत यह अपील अस्ीकार कर किनरस्त किकया ाता है।" 8. Section 12 of Juvenile Justice (Care & Protection of Children) Act, 2015 reads as under: “(1) xxxxxx Provided that such person shall not be so released if there appears reasonable grounds for believing that the release is likely to bring that person into association with any known criminal or expose the said person to moral, physical or psychological danger or the person’s release would defeat the ends of justice, and the Board shall record the reasons for denying the bail and circumstances that led to such a decision.” Page No.4 9. Considering facts of this case, nature of offence, submission of learned counsel for the parties, provisions of Section 12 of Juvenile Justice (Care & Protection of Children) Act, 2015, particularly the submission that applicant has committed the alleged offence/crime with minor victim aged about 11 years, further considering that the probation officer has made adverse remarks against the applicant that he used to drink alcohol and on the basis of said social report keeping the child conflict with law in safe custody is in his best interest, this Court is of the opinion that learned Sessions judge has rightly rejected/dismissed the appeal of the applicant. 10. Accordingly, the instant revision is hereby rejected. However, concerned Court below/Board is directed to expedite the trial, as early as possible. Certified copy as per rules.
