ORAL ORDER (PER: THE HON'BLE MR. JUSTICE S G PANDIT)
The State Authorities in Health and Family Welfare Department are before this Court in this petition under Article 226 of the Constitution of India questioning the correctness and legality of Order dated 28.08.2024 in Application No.10264 of 2024 passed by the Karnataka State Administrative Tribunal, Belagavi (for short ‘Tribunal’) whereunder the first respondent's application is allowed directing the respondents to consider the case of the respondent No.1 for compassionate appointment. The order of the Tribunal reads as follows:-
“Accordingly, the application is allowed. The impugned endorsement bearing No.¹fJ(2)/02/2019-20, dated 20.07.2023 (Annexure-A2) issued by the 2nd respondent is quashed. The respondents are directed to consider the application filed by the applicant seeking compassionate appointment without giving room for further litigation and pass appropriate order in providing compassionate appointment, within a period of three months from the of date receipt of copy of this order.”

2. Heard Sri G.K.Hiregoudar, learned Principal Government Advocate for petitioners and perused the entire writ petition papers.
3. Learned Principal Government Advocate would submit that the respondent is the married daughter of deceased government servant who died on 25.02.2018. He submits that the provision was made for appointment on compassionate ground to married daughters by way of amendement dated 09.04.2021. Hence, first respondent would not be entitled for the compassionate appointment. The said contention is answered by Co-ordinate Bench in Writ Petition No.15961 of 2022 dated 23.08.2024. In terms of the Order of the Co-ordinate Bench, the present writ petition stands rejected.
4. Pending applications, if any, stands disposed of.
