2025:KER:26739 2 ORDER Dated this the 28th day of March, 2025 Petitioner is the 12th accused in Crime No.190 of 2002 registered at the Irinjalakuda Police Station for offences punishable under Sections 143, 147, 148, 324, 326 and 308 read with Section 149 of the Indian Penal Code, Section 27 of the Arms Act and Section 3(1)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act. After committal, the case was numbered as C.C.No.304 of 2006 on the files of the Sessions Court, Thrissur. While so, petitioner left the country for taking up employment abroad. Thereafter, some of the accused faced trial and were convicted. Due to petitioner’s absence, the case against him was split up and later included in the Long Pending Register. This Criminal Miscellaneous Case is filed seeking an opportunity to surrender and for a direction to the court

2025:KER:26739 3 below to consider petitioner’s bail application on the day of surrender itself. 2. Learned Counsel for the petitioner submits that his client had gone abroad under compelling circumstances, since delay would have resulted in loss of employment. It is submitted that the petitioner is ready and willing to surrender, but is apprehensive that his bail application will not be considered on the same day. 3. I heard the learned Public Prosecutor also. 4. Considering the limited relief sought, the Criminal Miscellaneous Case is disposed of with the following directions; (i) Petitioner shall surrender before the trial court and move an application for bail, with advance notice to the Public Prosecutor, within two weeks.
