1. This appeal has been filed by the driver of the offending vehicle challenging the recovery rights granted against them in favour of the Insurance Company by judgment dated 07th November 2013 passed by Motor Accidents Claims Tribunal [‘MACT/Tribunal’], Dwarka Court, New Delhi.
2. Mr. Pradeep Gaur, counsel, appears for the Insurance Company, while Mr. Anirudh Yadav, counsel, appears for appellant/ legal heirs of driver of offending vehicle.
3. This appeal arises out of an accident which occurred on 05th May 2007, resulting in injuries to one Ram Kishan, aged 53 years.
4. Recovery rights were granted to the Insurance Company on the ground that no valid permit in respect of the offending vehicle had been placed on record.

the original respondent no.1 before the MACT, had filed a written statement before the Tribunal along with a copy of the permit, which was valid on the date of the accident. However, he did not appear thereafter, as a result of which recovery rights were granted in favour of the Insurance Company.
6. Mr. Yadav has now placed on record the original permit, which shows that it is a National Permit issued on 13th November 2006 and valid up to 12th November 2011.
7. Mr. Gaur has no objection if the matter is remanded to the MACT for verification of this permit.
8. Accordingly, the matter is fixed before the MACT on 25th August 2026, the date already fixed before the Execution Court in the execution petition filed by the Insurance Company.
9. Till then, no coercive action be taken against appellant.
10. Depending on the result of the verification, requisite orders will be passed by the MACT.
11. The appeal is disposed of in terms of above order.
12. Pending applications, if any, are rendered infructuous.
13. Copy of order be given dasti under the signature of the Court Master.
