It is submitted that both parties have decided to live peacefully, forgetting the unfortunate - 5 - HC-KAR NC: 2025:KHC-D:12029 CRL.P No. 102230 of 2024 past events, and both the Petitioners and Respondent No.2 have no objection to the allowing of the above criminal petition. 6. The Petitioners and Respondent No.2 have voluntarily signed this joint memo without any undue influence, coercion, or threat from any person, and of their own free will and volition, with the intent to resolve the dispute once for all. Therefore, the Petitioners/Accused Nos.1 to 4 and Respondent No.2 jointly pray that this Hon'ble Court may be pleased to quash the entire proceedings in C.C.No.1473/2024(Crime No.45/2024 registered at Karatagi Police Station), pending before the learned Additional Civil Judge and JMFC Court, Gangavathi (Now itinerant court at Karatagi), for the offences punishable under Sections 498A, 323, 504, and 506 read with Section 34 of the IPC, in the interest of justice and equity. 3. Learned High Court Government Pleader for respondent No.1-State submits that in view of the compromise arrived between the parties, the Court may accept the joint memo and quash the proceedings. - 6 - HC-KAR NC: 2025:KHC-D:12029 CRL.P No. 102230 of 2024 4. Smt. Durgabhavani @ Shribhavani, de facto complainant/respondent No.2 is appearing through video conference and submits that with the intervention of elders and well-wishers of the family, the dispute between her and her husband-accused No.1 has been amicably settled and they are now residing together and leading a harmonious matrimonial life and hence, she has no objection for quashing of the entire criminal proceedings against the petitioners/accused herein. 5. Since the de facto complainant has compromised the dispute with the accused persons, it will be a futile exercise, if the petitioners-accused are subjected to trial, since the probability of their conviction is remote and bleak. In view of the settlement arrived at between the parties, the continuation of the criminal proceedings will be abuse of process of law. 6. Joint memo is taken on record. 7. Accordingly, the criminal petition stands allowed and as a sequel, the proceedings in C.C.No.1473/2024(Crime No.45/2024 registered in Karatagi PS) pending on the file of learned Addl. Civil Judge(Jr.Dn.) and JMFC, Gangavathi (Now - 7 - HC-KAR NC: 2025:KHC-D:12029 CRL.P No. 102230 of 2024 itinerant Court at Karatagi) registered by Karatagi Police Station, Koppal, Gangavathi, against the petitioners/accused Nos.1 to 4, for the offences punishable under Sections 498A, 323, 504 and 506 read with Section 34 of the Indian Penal Code, 1860, are quashed.
