Present applicant–Ankush Katariya S/o Ompal Katariya is in judicial custody since 17.03.2025 and seeking bail in relation to FIR/Case Crime No.0100 of 2025, registered on the basis of FIR dated 14.03.2025 at Police Station Vikasnagar, District Dehradun, which was lodged against two persons, namely, Sagar, Himanshu Sharma as well as against five unknown persons for the offences punishable under Section 324(2), 326(g) and 351(3), 3(5) of the BNS, 2023. 4. Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated, which is also evident from the fact that the applicant is not named in the FIR, though the FIR was lodged against the five unknown persons. Apart from this, he submits that the another co-accused, namely, Sagar has already been enlarged on bail vide order dated 24.04.2025, wherein there is a reference that the complainant has already resolved the dispute. 5. He further submits that the complainant himself submitted an affidavit before the SSP and the main cause of fire was due to short circuit. 6. On the other side, Mr. V.S. Pal, learned AGA have not disputed this fact 2025:UHC:3565 that the other co-accused-Sagar has already been enlarged on bail and as such, the applicant also deserves for bail on the ground of parity. 7. After hearing the arguments, as advanced by learned counsel for the parties, and further taking into consideration that the other co-accused- Sagar has already been granted bail, this Court is of the view that the applicant deserves to be enlarged on bail. 8. Accordingly, without expressing any opinion on the merit of the case, the present bail application is allowed. 9. Let the applicant, namely, Ankush Katariya, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
