HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Judgment / Order 21/02/2025 This writ petition is filed under Article 227 of the Constitution of India assailing the legality and validity of the order dated 02.06.2023 passed by the learned Rent Tribunal, Jhunjhunu (for brevity “the learned Rent Tribunal”) whereby, an application filed by the petitioners/tenants for consolidation of the two rent applications, has been dismissed.
[2025:RJ-JP:7853] (2 of 2) [CW-2666/2025] The relevant facts in brief are that the respondent/landlord filed an application under Section 9 of the Rajasthan Rent Control Act, 2001 (hereinafter referred to as “the Act of 2001”) against the petitioners/tenants seeking their eviction from the subject commercial property. Stating that since, one another person namely Shri Satyaveer Singh has also filed an application under Section 9 of the Act of 2001 against them qua the selfsame property, the petitioners filed an application seeking consolidation of both the applications which has been dismissed by the learned Rent Tribunal vide order impugned dated 02.06.2023. Although, learned Senior Counsel for the petitioners assailed the order on its merit with eloquence; he, however, admitted in all his fairness that since, in one of the original applications, evidence of the applicant is complete, in view of this subsequent development, consolidation is not feasible now. In view thereof, this civil writ petition is dismissed. Pending application(s), if any, also stands disposed of.
