Neutral Citation No. - 2025:AHC:102258 Court No. - 83 Case :- APPLICATION U/S 529 BNSS No. - 1628 of 2025 Applicant :- Umesh Kumar Mishra Opposite Party :- State Of U.P. And 4 Others Counsel for Applicant :- Hari Shankar,Mool Chandra Mishra Hon'ble Nalin Kumar Srivastava,J. 1. This application under Section 529 BNSS has been filed with a prayer to direct the Court of Civil Judge (S.D.) / F.T.C., Jaunpur to decide the Case No.26072 of 2022 (State Vs. Harishchandra and others) arising out of case crime no.69 of 2022 under Sections 323, 504, 325 IPC, Police Station Sujanganj, District Jaunpur, expeditiously within a stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant before this Court is the informant in this case. After passing the summoning order in 2022, the accused persons anyhow appeared before the court and they were granted bail but since 22.3.2023 they are not appearing and the court has not been able to frame charge against them and in the meanwhile, a discharge application was also moved, which is pending. 5. I have considered the submissions and perused the entire record. 6. It reflects from the perusal of the order-sheets that the case is pending at the stage of disposal of discharge application moved by the accused persons. 7. In these circumstances, the Court concerned is directed to decide the discharge application moved by the accused persons as per law within two months from the date of production of certified copy of this order before it and if the discharge application is rejected by the court, it shall immediately proceed to frame the charges against the accused persons and thereafter all endeavours shall be made by it for the expeditious disposal of the case under reference, if there is no legal impediment. 8. It is also made clear that the Court / Presiding Officer is not the only stake holder in the trial and disposal of a case, hence, besides the P.O. concerned, all the stake holders i.e. police and executive authorities, counsels, parties to the case, staff etc. are also made bound by this order and it will be their responsibility also to assist the Court in every manner for the expeditious disposal of this case. 9. With the above observations, the application stands disposed of.
