Coram : Hon’ble Mr. Justice N.S.Shekhawat Present : Mr. Vipul Jindal, Advocate for the petitioner in CRM-M-32733-2024. Mr. Dhawaljeet Dutta, Advocate with Mr. Abhishek K. Kathpal, Advocate and Mr. Parveen Chauhan, Advocate for the petitioner in CRM-M-35049-2024. Mr. Deepinder Singh Brar, Senior DAG, Punjab. *** N.S.Shekhawat J.(oral)
1. This order shall dispose off above-said two petitions i.e. CRM-M-32733-2024, titled as Gurpreet Singh Vs. State of Punjab and CRM- M-35049-2024 titled as Manjit Kaur Vs. State of Punjab, whereby the petitioners have prayed for grant of regular bail to them in case FIR No.285 dated 15.09.2023 registered under Sections 21(C), 25 and 29 of NDPS Act, at Police Station STF, Mohali.
2.
Learned counsel for the petitioners contend that as per the case of the prosecution, Gurjant Singh @ Paras and Paramjit Kaur were arrested by the police, while they were carrying 01 kg of heroin in their conscious possession HEMLATA 2025.04.30 22:52 I attest to the accuracy and integrity of this document
CRM-M-32733-2024 & other connected case - 2- without any authorization. During the course of investigation, Paramjit Kaur and Gurjant Singh @ Paras are alleged to have suffered a disclosure statements and named the petitioners as co-accused in the present case. Gurpreet Singh and Manjit Kaur were arrested by the police on 15.09.2023 and are in custody since then. Learned counsel further placed reliance on the orders (Annexures P-4 and P-5) passed by this Court, whereby, Jaskaran @ Jaskaran Kaur and Sukhdev Singh alias Sukhdeo Singh, both similarly placed co-accused were granted the concession of bail by this Court. 3. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioners on the ground that during the course of investigation, certain call details have been found between the petitioners and their co-accused and even they were present in the area where Gurjant Singh @ Paras and Paramjit Kaur were found carrying the contraband. He further contends that Gurpreet Singh is involved in two more criminal cases, however, in one case, he has been acquitted by the competent Court. 4. I have heard learned counsel for the parties and perused the record carefully. 5. Admittedly, both the petitioners are in custody for the last more than 01 year and 07 months and the case is still listed for prosecution evidence. Thus, there are no chances of early conclusion of the trial. Moreover, similarly placed co-accused, namely, Jaskaran @ Jaskaran Kaur and Sukhdev Singh alias Sukhdeo Singh have already been granted the concession of bail by this Court, vide orders (Annexures P-4 and P-5). 6.
At this stage, without commenting on the merits of the case, the HEMLATA 2025.04.30 22:52 I attest to the accuracy and integrity of this document
