Mubarak Khan, aged about 36 years, son of Samsuddin Khan, resident of Village Kharagdiha, P.O. and P.S. Jamua, District Giridih, Jharkhand. ....Petitioner Versus The State of Jharkhand ....Opp. Party --------- CORAM: HON’BLE MR. JUSTICE DEEPAK ROSHAN --------- For the Petitioner : Md. Zaid Ahmed, Advocate For the Opp. Party : Mr. Bhola Nath Ojha, Spl.P.P. --------- 04/02.05.2025 Heard learned counsels for the parties. 2. The instant bail application has been preferred by the petitioner for grant of regular bail in connection with N.D.P.S. Case No. 04 of 2023, arising out of Jamua P.S. Case No. 315 of 2023, registered for the offence under Section 20(6)/(B)/25 of N.D.P.S. Act, pending in the Court of learned Sessions Judge, Giridih. 3. Learned counsel for the petitioner submits that earlier the petitioner was granted bail by this Court but unfortunately, he could not appear before the Trial Court and his bail was rejected for misuse of bail. Thereafter, he remained in custody for more than 5 months. As such, keeping a sympathetic view, bail may be granted. He is ready to abide by every condition imposed by this court. 4. Learned Spl. P.P. opposes the prayer for bail of the petitioner. 5. Having regard to the aforesaid submissions and the fact that after his arrest, the petitioner remained in custody for about 5 months, I am inclined to enlarge this petitioner on bail. 6. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Giridih in connection with N.D.P.S. Case No. 04 of 2023, arising out of Jamua P.S. Case No. 315 of 2023. 2025:JHHC:13249 2 7. It is made clear that the petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co-operate in trial and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
