Neutral Citation No. - 2025:AHC:103990 Court No. - 34 Case :- WRIT - C No. - 17478 of 2025 Petitioner :- Ashok Kumar And Another Respondent :- State Of U.P. And 9 Others Counsel for Petitioner :- Anand Prakash Paul,Brij Bhushan Paul Counsel for Respondent :- C.S.C.,Sher Bahadur Singh Hon'ble Rohit Ranjan Agarwal,J.
1. This writ petition has been filed with the following prayer:
"A. Issue a writ order or direction in the nature of mandamus respondent no.3 to forthwith accorded his approval to the resolution of respondent Land management Committee dated 28.6.2023 as stipulated under section 125 of U.P. Revenue Code, 2006, and so enable respondent land management committee to transfer possession of land allotted to allottees mentioned hereinabove and complete allotment remaining for members. B. Issue a writ order or direction in the nature of mandamus respondent no. 4 to forthwith order criminal prosecution of respondent no. 11 for illegal malafide of Rs.37,50,000/- for approving resolution of land management committee dated 28.6.2023 (Annexure no.2)."
2. It is contended that a resolution was passed by Land Management Committee granting lease to 125 landless labourers. The letter was sent for approval to Sub-Divisional Officer, respondent No.3 in the year 2023 but till date no decision has been taken by respondent No.3 Sub-Divisional Officer, Tehsil Puwayan, District Shahjahanpur.
3. I have heard learned counsel for the petitioners, learned Standing Counsel for the State and perused the material on record.
4. From perusal of record it transpires that Sub Divisional Officer, Tehsil Puwayan, District Shahjahanpur is sitting tight over the matter for more than two years. He is directed to immediately take a decision on the resolution passed by Land Management Committee for approval either approving or disapproving. He being the Revenue Officer cannot sit over the file for such a long time. This Court directs him to immediately take a decision within one week from the date of production of a certified copy of this
order.
5. In case the decision is not taken by the officer concerned within the said period, it will amount to contempt of this Court.
6. With the aforesaid direction, present writ petition stands
disposed of.
7. It is made clear that this Court has not adjudicated the case on merit.
