S. No. 81 Suppl. IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CCP(S) 18/2025 in[WP(C) 3239/2023] MOHAMMAD MAQBOOL BHAGAT …Petitioner(s)/Appellant(s) Through: Mr. B. A. Misri, Advocate Vs SH.SANJAY KUMAR SECRETARY TO SCHOOL EDUCATION AND ORS ...Respondent(s) Through: CORAM: HON’BLE MR JUSTICE RAHUL BHARTI, JUDGE ORDER 07.02.2025 1. This contempt petition is premature as petitioner is yet to earn his monthly wages after pronouncement of an order dated 03.12.2024 of the writ court in terms whereof the daily wages payable to the petitioner as Night Chowkidar is meant to be at the rates of minimum wages in currency. 2. For the month of December, 2024 followed by month of January, 2025, the petitioner is said to have not received wages, as such, the petitioner cannot have the cause to clamor that the daily wages to him have been paid at the rate lesser to the minimum wage in currency. 3. Therefore, this contempt petition is held to be premature and petitioner shall be well within his right to come up with a contempt petition as and when he is paid his daily wages and if the same are payable at the minimum wage scale then the petitioner would have no cause to agitate any contempt against the officers as named in the present contempt petition.
