The petitioner has preferred present writ petition inter-alia with the prayer to ensure the payment of salary in favour of the petitioner. 3. Facts in brief as contained in the writ petition are that petitioner was issued a letter of appointment under dying-in-harness rules on 06.06.2023 by the respondent no.3 namely District Basic Education Officer, Moradabad. Pursuant to the aforesaid petitioner joined the post of Assistant Teacher in Primary School, Nuriyo Sarai Got, Block Moradabad Gramin, Moradabad on 04.07.2023 and since then working regularly. 4. It is argued by counsel for the petitioner that though the petitioner is discharging her duties as Assistant Teacher but salary was not paid to her since Account Officer in the office of District Basic Education Officer, Moradabad/respondent no.4 raised certain objections and written a letter in this regard to the respondent no.3-District Basic Education Officer, Moradabad on 02.02.2024, copy of which is appended as annexure-4 to the writ petition. It is stated in paragraph 11 of the writ petition that in order to resolve the controversy the respondent no.4 wrote a letter to the Director of Education (Basic), U.P., Lucknow on 09.08.2024 asking clarification on certain points. Since no decision has been taken in the matter, petitioner has preferred present writ petition. 5. Pursuant to the order passed by this Court, the decision taken by the Director of Education (Basic), U.P., Lucknow dated January 22, 2025 was placed before this Court, the same is taken on record. The decision reads as follows :- "उपररो्ሹ वविषयक अपनने ककायका቟ኋलय कने ्ቚ०सहका 0/10823/2024-25 वदिनकााሪक 22.01.2025 कका साሪदिर቟ኋ ्ቇहण करर , जजिसकने दकारका शቦኍमतቦኍ परविनेजिजुल वनशका पत्नቦኍ स्वि० आररफ आवदिल फकारुकक , सहकायक अध्यकापक कने सबाሪध मर आख्यका उपलब्ध करकायቦኍ गयቦኍ हहै। ्ቚकरण मर अविगत करकायका गयका हहै वक शቦኍमतቦኍ परविनेजिजुल वनशका पत्नቦኍ स्वि० आररफ आवदिल फकारूकक , सहकायक अध्यकापक कका वशककावम्ቔ कने रूप मर मकाह अक्टटबर, 2022 तक कने मकानदिनेय कका रजुगतकान वकयका गयका हहै तथका वशककावम्ቔ कने पदि सने वदिनकााሪक 17.04.2023 करो त्यकागप्ቔ दिने वदियका गयका हहै। शቦኍमतቦኍ परविनेजिजुल वनशका पत्नቦኍ स्वि० आररफ आवदिल फकारूकक , सहकायक अध्यकापक दकारका वदिनकााሪक 17.04.2023 करो वशककावम्ቔ कने पदि सने त्यकागप्ቔ वदियका गयका , कने दृवቖኌगत तथका वशककावम्ቔ कक वनयजुव्ሹ साሪवविदिका आधकाररत हहै जिरो वनयवमत सनेविकायरोजिन कक शनेणቦኍ मर नहीሻ आतका हहै। अततः आपकरो वनदिरवशत वकयका जिकातका हहै वक शቦኍमतቦኍ परविनेजिजुल वनशका यवदि ममृतक आजशत कने अाሪतग቟ኋत अनजुकम्पका वनयजुव्ሹ कक अन्य अह቟ኋतका करो पटण቟ኋ करतቦኍ हहै , तरो ऐसቦኍ सस्थवत मर विनेतन वि अन्य दिनेयकोሗ कका रजुगतकान वकयका जिकानका सजुवनसशቐኌत करर।" 6. From perusal of the same, it is clear that specific direction has been given after removing the deficiencies as pointed out by the respondent nos.3 and 4 and a direction was given to them to make the payment of salary along-with arrears. 7. From perusal of the record it is clear that the short comings if any which was found by the respondent nos.3 & 4 for the appointment of the petitioner on account of which she was not paid her salary has already been removed in favour of the petitioner by the Director of Education (Basic), U.P., Lucknow vide its order dated 22.01.2025 as quoted above. 8. In this view of the matter, a mandamus is issued to the respondents no.3-District Basic Education Officer, Moradabad & respondent no.4-Accounts Officer at the office of District Basic Education Officer, Moradabad to make the payment of salary to the petitioner month by month as and when it falls due till January, 2025 forthwith. In so far as arrears of salary is concerned, the same should be paid to the petitioner within a period of six weeks, thereafter. 9. Accordingly, present writ petition is disposed off.
