The petitioner claims that she is entitled to make recomputation of pension. She has made a representation before the competent authority but to no avail. The only prayer made by Shri Kanhaiya Lal, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Anand Kumar Srivastava for the respondent No.3 submits that the matter requires determination of facts by the competent authority in light of the applicable provisions of law in the first instance. However, he fairly contends that her claim regarding recomputation of the pension is liable to be decided by the competent authority in a reasonable time frame. In wake of the submissions made at the Bar and without going into the merits of the case, the Executive Officer, Nagar Palika Parishad, District-Basti/respondent No.3 is directed to decide the representation of the petitioner regarding recomputation of the pension in accordance with law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of.
