[2025:RJ-JP:30510] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1949/2025 Anil Kanjar S/o Rambilas, Aged About 24 Years, R/o Bhamawada Mahuwa Wala Dera, Police Station Kumbhraj, District Guna (M.p.) (At Present Accused Confined In District Jail Jhalawar) ----Petitioner Versus State Of Rajasthan, Through Pp. ----Respondent For Petitioner(s) : Mr. Vidit Rai Kumawat For Respondent(s) : Ms. Manju Dave, PP HON'BLE MR. JUSTICE ASHOK KUMAR JAIN Order 07/08/2025 1. This instant application for bail filed under Section 483 of B.N.S.S. by the applicants-accused Anil Kanjar S/o Rambilas in FIR No. 177/2024 dated 30.05.2024 registered at P.S. Khanpur, District -Jhalawar, whereby the applicant-accused has charged under Sections 457 and 380 of IPC. 2. Learned counsel for applicant submits that applicant-accused is in custody for last one year and a Co-ordinate Bench of this Court has allowed the bail of present applicant in two other matters. He further submits that appellant-accused will not indulge in criminal activities after being released on bail. 3. Aforesaid contentions were opposed by learned Public Prosecutor and she submits list of 10 cases which is enclosed in the order of Trial Court which indicate that applicant is having a criminal background. [2025:RJ-JP:30510] (2 of 2) [CRLMB-1949/2025] 4. Heard learned counsel for the applicant along with learned Public Prosecutor. 5. Having considered the submission of learned counsel for the applicant and learned Public Prosecutor, I am of the considered view that applicant is having a criminal background and he is in habit to commit offence of similar nature, particularly under Sections 380, 382, 387, 399 etc. 6. The grant of bail by Co-ordinate Bench is not a ground to release the appellant-accused in the instant case, moreover, the appellant-accused is charged under Section 457, 380 and 395 IPC which is a heinous offence and one year custody is not sufficient to grant bail on ground of custody, in view of criminal antecedents thus, it is not appropriate to release the appellant-accused on bail. 7. Accordingly, S.B. Criminal Miscellaneous Bail Application No. 1949/2025 preferred by Anil Kanjar S/o Rambilas is hereby dismissed. (ASHOK KUMAR JAIN),J MONU /43
