1. Heard learned counsel for the petitioner. 2. The instant writ application has been preferred by the petitioner praying therein for a direction upon the respondents to take necessary steps for giving regular and time bound promotion to this petitioner who has not been given a single promotion in spite of his long 35 years of satisfactory services. The petitioner has further prayed for a direction upon the respondents for fixation of pay scale in appropriate scale and to take necessary steps for preparation/calculation of his pension papers, Gratuity, G.P.F. and all retiral benefits permissible to the petitioner in view of his incoming superannuation from service

After some arguments, learned counsel for the petitioner fairly submits that after filing of the instant writ application, much water has flown and several judgments has settled the issue of Time Bound Promotion/A.C.P. and due to communication gap the petitioner is also not aware as to whether the law laid down by this Court and the Hon’ble Apex Court with regard to the issue involved in this case has been applied to this petitioner or not; as such, he prays that the instant application may be disposed of with a liberty to the petitioner that if at all the Time Bound Promotion benefit has not been extended to this petitioner, the petitioner may be at liberty to approach the concerned officer. 4. None appears for the respondents as it has been fairly submitted by the lawyers that now, Mr. Rajesh Kumar, who was advocate on record along with other lawyers, is not appearing on behalf of the respondents.
Since it is an old matter; as such instead of issuing notice to the respondents and also in view of the fact that no specific direction is to be given, the instant writ application is being disposed of in absence of counsel for the respondents. 5. Having regard to the aforesaid facts and circumstances and the submissions of the petitioner, the instant application stands disposed of with the liberty as prayed for by the petitioner. It goes without saying that if the petitioner approaches the concerned respondent, he shall verify the records of the case
