I Heard learned counsel for the Petitioners, learned Assistant Government Pleader for Home appearing for respondent State and learned counsel appearing for respondents 5 to 8. Perused the material on record.
Learned counsel for the Petitioners would submit that Petitioners have filed a civil suit for permanent injunction and obtained a decree in their favour in OS No. 105 of 2009 on the file of the Court I Additional Junior Civil Judge, Anakapalli, Visakhapatnam. On the other hand, learned counsel for respondents 5 to 8 would submit against the
order of the Civil Court passed in favour of the Petitioners, respondents 5 to 8 preferred an appeal suit and obtained stay of Judgment and Decree passed in the Civil Suit and the appeal suit is pending on the file of the Court of X Additional District and Sessions Judge, Anakapalle, for consideration. Learned Assistant Government Pleader for Home would submit that the Court there are civil disputes pending between the parties and that this Court may pass appropriate orders. As can be seen from the material placed on record, civil cases are pending between the parties before competent Civil Courts. In that view, this Writ Petition is disposed of. Parties are at liberty to work out their remedies before competent Civil Courts according to law, where the cases are pending. No order as to costs. Pending applications, if any, shall stand closed.
