It is contended that in the suit instituted by plaintiffs- respondents, an application for grant of temporary injunction was moved which was allowed by trial court against which the defendants have filed a Misc. Civil Appeal No. 30 of 2025, which is pending consideration. According to petitioners' counsel, only notice has been issued on the misc. appeal and the same has remained pending consideration. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon appellate court to proceed with Misc. Civil Appeal No. 30 of 2025 and decide the same, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order also considering the stay application moved in the said appeal. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
