HEARING IN B-GROUP, THIS DAY, THE COURT MADE THE FOLLOWING: ORAL ORDER (PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA) 1. The petitioner is before this Court calling in question the appointment of the fourth respondent as Anganwadi Worker to the Anganwadi Centre at Chunchanur. 2. Heard the learned counsel Shri H.M. Dharigond appearing for the petitioner; learned HCGP Smt. Kirthilata R.Patil appearing for respondent Nos.1 to 3; & learned counsel Shri B.M. Angadi appearing for respondent No.4. 3. The third respondent issues a notification calling for applications from the eligible persons to the post of Anganwadi Workers on 22.02.2013. The petitioner and the forth respondent both finding themselves eligible and apply for the said post. The petitioner is not chosen for appointment, but the forth respondent is appointed to the said post. This is what has called in question by the petitioner - 3 - NC: 2025:KHC-D:1221 WP No. 83733 of 2013 before this Court. The solitary ground projected by the learned counsel appearing for the petitioner is that the fourth respondent is not the resident of Chunchanur for which the notification was issued. 4. Learned counsel would submit that the petitioner is the resident and has to be considered, this Court had directed the enquiry to be conducted with regard to the status of residence of both the petitioner and the fourth respondent. 5. The enquiry report is placed before Court, which clearly depicts that the fourth respondent is the resident of the said place. 6. In that light, the solitary challenge by the petitioner would fail and therefore there would be no interference with the appointment of the fourth respondent.
