1. The petitioner has filed the instant petition for the following relief:
“I. Issue a writ of declaration or any other appropriate writ, order or direction declaring that the acts and omissions of the respondent police officials of Police Station Lajpat Nagar in refusing to receive and register the Petitioner’s complaint dated 24.12.2025, and in making a 75-year-old senior citizen wait and return without redressal, are illegal, arbitrary, unconstitutional and in gross violation of the mandatory provisions of the Punjab Police Rules, 1934 (as applicable to Delhi), the Bharatiya Nagarik Suraksha Sanhita, 2023, the Delhi Police Circular dated 07.05.2014 titled “Action on Complaints of Senior Citizens”, and Articles 14 and 21 of the Constitution of India. II. Issue a writ of mandamus or any other appropriate writ, order or direction directing the Respondents to forthwith receive, register, This is a digitally signed order. acknowledge and act and also consider conducting of preliminary enquiry as contemplated under section 173 (3) (i) of BNSS upon the Petitioner’s written complaint dated 24.12.2025 (Annexed with the petition as Annexure P-2). III. Pass an order directing the commissioner of police to register and act on the complaint dated 24.12.2025 sent via e-mail to the commissioner of police (annexed with the petition as Annexure P-1) and further direct action against the erring police officials, including the concerned SHO and other responsible officers of Police Station Lajpat Nagar, for refusal to receive and register the Petitioner’s complaint, violation of the Punjab Police Rules (applicable to Delhi), and section 173 of BNSS, and for the harassment caused to a senior citizen. IV. Issue appropriate directions to ensure protection, safety and dignity of the Petitioner, a 75-year-old senior citizen, and to secure his life and property in accordance with law.
V. Issue a writ, order or direction directing strict compliance and enforcement of the Delhi Police Circular dated 2014 titled “Action on Complaints of Senior Citizens”, and to take appropriate action against the officers who acted in violation thereof, so as to ensure that senior citizens are given prompt, respectful and lawful redressal of their complaints at police station level. VI. Issue a writ, order or direction directing the Respondents to forthwith preserve, secure and produce before this Hon’ble Court the complete CCTV footage, including audio where available, of Police Station Lajpat Nagar for the relevant period on 24.12.2025, particularly covering the time during which the Petitioner visited the police station to lodge his complaint, and further direct that the said footage be procured and examined to ascertain the conduct of the police officials and ensure accountability, in the interest of justice.”

It was alleged by the petitioner in the complaint that on the intervening night of 23/24.12.2025 his daughter-in-law forcibly entered his premises with police assistance, broke CCTV cameras and locks and committed theft of gold jewellery worth approximately ₹6 – 8 lakhs and cash amounting to approximately ₹3 - 5 lakhs. 3. cognizable offence was made. The daughter-in-law was residing in the same premises. The petitioner however residing elsewhere. Paragraph nos. 3 to 5 of the status report are extracted as under:
“3. That statements of Ms. Manju and Mr. Rajeev, neighbours and eyewitnesses to the incident dated 23.12.2025, were also recorded during the enquiry. Their statements were found to corroborate the version of Smt. Yashika Sikarwar. 4. That a legal opinion was sought from the Legal Advisor, Sub- Division Lajpat Nagar, in respect of the present complaint. As per the said legal opinion, no cognizable offence is made out in the present matter. 5.
That in view of the facts and circumstances of the case, statements recorded, documents collected, and the legal opinion obtained, no cognizable offence is disclosed. Accordingly, the complaint has been filed after due enquiry, as the dispute pertains to matrimonial issues, which are already the subject matter of proceedings before the competent civil courts. However, any directions passed by the Hon’ble Court shall be complied with meticulously.”
4. In view thereof, no direction can be issued to register an FIR against the private respondent. The petitioner, however, shall be at liberty to take appropriate recourse in accordance with law, if the same is permissible. 5. With these observations, the petition stands disposed of.
