Hon'ble Ram Manohar Narayan Mishra,J. 1. The petitioner has applied for renewal of passport. On 17.3.2025, he was issued a notice by Regional Passport Office, Lucknow, requiring the petitioner to offer explanation in respect of FIR No. 249 of 2019, under Sections 419, 420, 447, 448, 504 and 506 IPC, P.S. Rohaniya, Varanasi. 2. The case of the petitioner is that although the petitioner was named in the said FIR, but the police after investigation submitted a charge sheet in which the petitioner was not named as an accused, as no evidence was found against the petitioner. Learned Magistrate has already taken cognizance on basis of the charge sheet submitted by the police and the petitioner has not been summoned, nor any criminal case is pending against him. The petitioner submitted a detailed explanation to the show cause notice on 11.4.2025. The case of the petitioner is that the Regional Passport Officer despite the petitioner having submitted his explanation, has not renewed the passport so far. 3. Sri Sanjay Dwivedi who has appeared for respondent no. 4, i.e. Regional Passport Officer, Lucknow, submits that appropriate decision would be taken by respondent no. 4 considering the explanation submitted by the petitioner. 4. Accordingly, the petition is disposed of with direction to respondent no. 4 to take appropriate decision in respect of the prayer of the petitioner for renewal of his passport within a period of four weeks from the date of communication of the instant order along with supporting evidence.
