The sole prayer made in the instant petition is for issuing a writ of mandamus commanding the respondent no. 2 to decide the representaiton of the petitioner dated 28.03.2025. In the said representation, the petitioner has made prayer for refund of Rs. 2,48,00,000/- deposited by him towards allotment of commercial plot or in alternative reschedule the payment of the balance amount. 2. We observe that the prayer for reschedulement was not entertained in previous writ petition of the petitioner bearing No. 31583 of 2024. On query made from counsel for the petitioner as to how representation for the said prayer would be maintainable, he states that the petitioner will not press the said prayer and the Authority be directed to consider only the prayer for refund of Rs. 2,48,00,000/- deposited by the petitioner so far. 3. Sri Dhananjay Awasthi, counsel for the respondent - Development Authority has no objection to consider the said limited prayer. 4. Accordingly, the petition is disposed of by providing that only the prayer of the petitioner for refund of Rs. 2,48,00,000/- in terms of the representation dated 28.03.2025 be considered by the respondent - Development Authority within six weeks from the date of communication of the instant order along photocopy of the representation.
