Jyotsna Rewal Dua , J Pursuant to the hearings held in this case from time to time, respondent No.3 has placed on record an affidavit of its Managing Director, which reads as under:-
“ I, Dr. Jeet Singh Rana, S/o Sh. Shakti Chand Rana, Managing Director, Modern Nursing College, Annadale Shimla-3, H.P., Aged 52 years, do hereby affirm and declare on oath as under:- 1 Whether reporters of the local papers may be allowed to see the judgment?

1. That the above titled petition is pending adjudication before this Hon'ble Court.
2. That in order to put an end to litigation, the respondent No.3, without pressing any of the defences raised by it in its reply, is ready to grant re-admission to the petitioner, Ms. Supriya Thakur, to the Second Year of M.Sc. Nursing Course, for the academic Session commencing from September-October 2025, subject to her payment of fees.
3. That the rustication orders of the petitioner, Ms. Supriya Thakur, shall be withdrawn subject to her withdrawing the allegations made in the petition, undertaking to attend theory and practical classes regularly on re-admission, undertaking to complete her thesis work under the Guide allotted by the College and undertaking to maintain discipline in the College.
4. That I further declare on solemn oath that this affidavit of mine is true, no part of it is false and nothing material has been concealed therefrom Affirmed at Shimla on 6th day of May, 2025.”

Learned counsel for the petitioner, on the basis of instructions from the petitioner, who is present in person, states that petitioner accepts all conditions imposed by respondent No.3 in the above affidavit for her re-admission to the Second Year of M.Sc. Nursing Course, for the academic Session commencing from September-October 2025, subject to payment of stipulated fees as per prescribed period. Learned counsel has also assured that the petitioner will attend all her theories and practical classes regularly on re-admission and will complete her thesis work under the Guide allotted by respondent No.3-College and would also maintain discipline in the College.

3. In view of above, learned counsel on both sides submit that respective allegations levelled by the petitioner and respondent No.3 against each other be treated to have been withdrawn. Learned counsel for respondent No.3 submits that in view of petitioner’s agreeing to the conditions imposed in the above affidavit, her rustication order dated 26.09.2024 (Annexure P-5) by respondent No.3-College, be also treated to have been withdrawn.
4. The present writ petition is disposed of in terms of para-2 & 3 above. Parties to adhere to their respective stands noticed above. Pending miscellaneous application(s), if any, shall also stand
