1. This is an application filed under Section 151 of the CPC, 1908 seeking the following prayer(s):-
“a) be pleased to direct Respondent No. 3/4 to de-freeze the bank account of petitioner (A/c No. 61229100172) held with State Bank of India, Vivek Vihar Branch (31502), D-332, Ground floor, Vivek Vihar, Delhi 110095, while holding the disputed amount of Rs. 2,08,999/- as security, during the pendency of the present Petition. …”
2. For the reasons stated in the application, issue notice. 3. Mr. Rout, learned standing counsel, accepts notice on behalf of the respondent No. 3 and has addressed some arguments. 4. 5. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayer:-
“a) be pleased to issue appropriate writ, order or direction to respondent 4 for de-freezing the bank account of petitioner (account number 61229100172) held with State Bank of India, Vivek Vihar Branch (31502), D-332, Ground floor, near Ram mandir, Vivek Vihar, Delhi 110095 and provide him all communication related to freezing of his bank account in the interests of justice; ...”

The case of the petitioner is that the petitioner is maintaining a Bank Account bearing No. 61229100172 with the respondent No. 3-4 Bank namely State Bank of India, Vivek Vihar Branch (31502), D-332, Ground Floor, near Ram Mandir, Vivek Vihar, Delhi 110095. 7. The account of the petitioner was freezed in October, 2024 without any intimation or information. Upon approaching the respondent No. 3-4 Bank, the petitioner was informed that his account was frozen on the basis of directions received from the Cyber Crime Wing Manesar. Hence, the present petition. 8. A perusal of paragraph No. 6 of the short affidavit filed by the respondent No. 3-4 Bank shows that the disputed amount is to the extent of Rs. 1,42,000/- and Rs. 66,999/- aggregating to Rs. 2,08,999/- . The paragraph No. 6 of the counter-affidavit reads as under:-

freeze/marked lien for an amount of Rs.1,42,000/- (Rupees One Lacs Forty Two Thousand Only) and for amount of Rs. 66,999/- (Rupees sixty Six Thousand Nine Hundred Ninety Nine Only).”

I am satisfied that placing a blanket lien/freezing of entire bank account or entire banking operations of an individual is an action entailing serious consequences creating severe hardships and also affecting the financial wellbeing of an individual. 10.I am of the view that the freezing of the bank account of the petitioner in its entirety putting the entire banking operations to a complete halt cannot be allowed when the dispute is only with regards to a portion/part of the account balance. In such a situation, the undisputed effective account balance cannot be frozen. 11. For the said reasons, subject to lien on Rs. 2,08,999/-, the petitioner shall be permitted to operate his Bank Account bearing No. 61229100172 held with the State Bank of India, Vivek Vihar Branch (31502), D-332, Ground Floor, near Ram Mandir, Vivek Vihar, Delhi
110095. 12. The petitioner is also at liberty to initiate appropriate action under the Standard Operating Procedure for removal of the lien on Rs. 2,08,999/-. 13. As no other relief is required in the present matter, the petition is
disposed of in the aforesaid terms.
