AdvcjtThfatLa for the Petitioner and of public prosecutor for the Relsprf`,mclem±, I,i:i'1e G®urf made the following, ., EEiiiiiii The Court made the following: + ORDER:- This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A.6, seeking regular bail, in Crime No.4 of 2015 of Cyber Crime Police Station, Visakhapatnam Commissionerate. 2. A case has been registered against the Petitioner herein and Others for the offences punishable under Sections 111 (2), 319(2), 318(4) read with 61 (2) of the Bharatiya Nyaya Sanhita, 2023 (for short {the BNS'), Sections 66-C and 66-D of the Information Technology Act, 2000-2008 and Sections 3 and 4 of the Andhra Pradesh Gaming Act, 1974. 3. Case of the prosecution, in brief, iS that, On 06.01.2025, on receipt of credible information, the Inspector of Police, Cyber Crime Police Station, visakhapatnam along with staff conducted search at FIat No.610, Gayatri Towers, Opp. Water tank and pump house, backside Of Polamamba temple, Doctors colony, Pedawaltair, Visakhapatnam and found that A.3 along with A.1, A.2, A.4 and A.5 conducting offline and Online betting. As per the confessional statement of A.3, he used to pool fund for the betting. Upon verification of mobile phones of A.3, police found a total eighty two suspicious transactions and the name of the petitioner was shown in such transactions. The petitioner was arrested On 17.01.2025 and got remanded to judicial custody. 4. Heard. PerusedthereCOrd. J} 5. Learned Assistant Public Prosecutor submits that the petitioner along with A.7 voluntarily Supported and Participated in the Organized Crime and funded the amounts to books and put those amounts in crime betting apps, in the alleged house and getting gains. He further submits that investigation is not yet completed. 6. A perusal of the material available on record goes to show that the cyber crime police, on credible information, commenced the investigation on o6.01.2025 and the Case iS Online Cricket betting involving CrOreS Of rupees with number of bank accounts, UPI transactions includ'lng binami and hawala transactions. As rightly contended by the learned counsel for the petitioner, pr,'ma fac,-e section 111(2) of BNS has no application in respect of the petitioner. This Court, considering the material On record, the nature Of accusation, pr,'ma facJ'e Case and the Stage Of -Investigation, iS inclined tO entertain the bail application of the pet-ltioner/A.6. 7. ln view Of the aforesaid facts and Circumstances Of the Case, this Court is inclined to grant bail to the petitioner herein on the following conditions: i) The pet'ltiOrier/A.6 sha" be released On bail on his executing a personal bond for Rs.10,000/-(Rupees Ten Thousand only) with two Sureties for a like sum each to the sat'lsfaction of the learned Chief Judicial Magistrate, visakhapatnam; and ezZzziy I- ii) On release, the petitioner shall `appear before the stall-on House Officer concerned once in a week i.e., on every sunday between 10.00 a.m. and 05.00 p.m., tI'Il filing of the charge sheet. 8, Accordl'ngly, the Criminal Petition I-S allowed.
