Present criminal appeal has been filed against the judgment and order dated 27.03.1987 passed in S.T. No.192 of 1980 (State of U.P. vs. Mohan Lal and Others), convicting the appellant no.1 and 3 under section 302 IPC as well as under Section 323 IPC read with Section 34 IPC, and convicting the appellant no.2 under sections 302 and 323 IPC. 2. As per office report dated 16.04.2025 based on the report of the C.J.M.,Prayagraj dated 29.03.2025, all three appellants, namely, Appellant no.1-Mohan Lal Yadav, appellant no.2-Nand Lal Yadav and appellant no.3- Hari Mohan Yadav died on 05.07.2019, 22.08.2018, 22.12.2017 respectively. In respect of their death statement of Chandrajeet, grand son of Mohan Lal Yadav, Mahendra Nath, son of Nand Lal Yadav and Indra Lal, son of Hari Mohan Yadav were recorded. In respect of their death, certificate issued by Gram Panchayat Babura is also on record. 3. Accordingly, criminal appeal stands abated. Re: Government Appeal NO.1922 of 1987 1. Present Government Appeal is de-tagged from the Criminal Appeal No.909 of 1987. However, lower courts' record of the criminal appeal shall remain connected alongwith the Government appeal. 2. Office is directed to list the Government Appeal before appropriate Bench in the next cause list.
