The present petition has been filed by the Applicant under Section 438 of the Code of Criminal Procedure, 1973 (hereinafter referred to as ‘Cr.P.C.’) read with Sections 482 and 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’) seeking anticipatory bail in FIR No. 80/2020, registered at Police Station Rani Bagh, Delhi, for offences punishable under Sections 406/420/34 of the Indian Penal Code, 1860 (hereinafter referred to as ‘IPC’). 3. Learned counsel for the petitioner submits that the petitioner is 80 years of age and is suffering from Parkinson’s disease and other age-related ailments. It is also submitted that the petitioner has joined the investigation pursuant to the directions of this Court. 4. Per contra, Learned APP for the State, opposes the grant of anticipatory bail and submits that the allegations against the petitioner pertain to offences of cheating and criminal breach of trust. It is submitted that the petitioner is a Director of the accused company and that the alleged amount was transferred into the account of the said company. It is submitted that the petitioner is enjoying the interim protection since 12.08.2025. 5. I have heard the parties and perused the material on record. 6. Interim protection has been granted to the petitioner on 12.08.2025 by this court pursuant to which the petitioner has joined investigation. It is also relevant to note that two of the co-accused have already been granted anticipatory bail by this Court in the year 2025. 7. Furthermore, the petitioner is 80 years of age and is suffering from Parkinson’s disease. His medical condition and advanced age constitute relevant considerations while examining the necessity of custodial interrogation, particularly when he has already joined the investigation pursuant to the interim protection granted by this Court 8. In the facts and circumstances of the present case, including the petitioner’s advanced age and medical condition, this Court is of the view that the petitioner has made out a case for grant of anticipatory bail. 9. Accordingly, in the event of arrest, the applicant shall be released on anticipatory bail on furnishing a personal bond in the sum of Rs. 50,000/- with one surety of the like amount to the satisfaction of the concerned SHO/Investigating Officer, subject to the following conditions: This is a digitally signed order.
