1. With the consent of learned counsel for both the parties, the matter is heard finally on admission.

The limited grievance of the petitioner is that on 09.04.2024 the learned trial court had granted time to respondent no. 5 to submit preliminary report but it has been more than eight months that no substantive progress has been made by the respondent no. 5. Since 06.05.2024 respondent no. 5 has neither appeared before
2 the learned Trial Court and on unreasonable time has been sought by respondent no. 5 to submit report. Petitioner is a 72 year old man and has faced mental trauma due to derogatory statement made against his son and his family for which the petitioner made various complaint to respondent no. 2 to 5 but no action has been taken.

Learned counsel for the petitioner prays this Court to allow the criminal miscellaneous petition and may direct the learned court below to expedite the proceeding of the complaint filed by the petitioner under Section 200 of Cr.P.C. pending before the Chief Judicial Magaistrate, Ambikapur, district Surguja (C.G.) since 09.04.2024 within a period of 03 months, in the interest of justice.
4. Considering the limited grievance of the petitioner and also the
judgment passed by the Hon’ble Supreme Court in the matter of Sangram Sadashiv Suryavanshi Vs. The State of Maharashtra arising out of SLP Criminal No. 13366/2024 where it is stated that "constitutional court, in the ordinary course, should refrain from fixing a time-bound schedule for the disposal of cases pending any other courts. Constitutional courts may issue directions for the time-bound disposal of cases only in exceptional circumstances. The issue of prioritizing the disposal of cases should be best left to the decision of the courts concerned where the cases are pending;”
5. However, on perusal of record this court finds that it is not an exceptional circumstances case and therefore, it is directed to
3 make all endeavors to conclude the proceedings pending before it preferably within 06 months from the date of receipt of copy of this order.
