1. Heard Sri Ashish Kumar Mishra, learned counsel for petitioner.
2. It is the case of petitioner that his sister while working as Assistant Teacher (Urdu) died-in-harness on 20.12.1999 leaving behind petitioner as her sole dependent and legal heir. Petitioner thereafter appointed on compassionate ground on 18.08.2004 and since then he is working.
3. Learned counsel for petitioner submits that all other death benefits were given to petitioner, however, his claim for family pension is still pending.
4. To the specific query of this Court that under which provision of law petitioner is entitled for both, i.e., compassionate appointment and family pension, no reply was given.
5. In aforesaid circumstances, the Court is of the opinion that petitioner is agitating a claim after about 25 years of death of his sister and after two decades of his appointment on compassionate ground. Since petitioner is now aged about 46 years, therefore, he has already crossed the maximum age for family pension.
6. Writ petition is accordingly dismissed. Order Date :- 22.5.2025 AK Digitally signed by :- AWADESH KUMAR High Court of Judicature at Allahabad
