The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed to quash the entire proceedings of complaint case No. 868 of 2012 as well as cognizance/summoning order dated 15.12.2011, whereby learned Magistrate took cognizance under Sections 323, 392, 452, 504, 506, I.P.C., Police Station Adampur, District Amroha, pending in the court of Civil Judge (Junior Division)/Judicial Magistrate, Hasanpur (Amroha). Learned counsel for the applicant fairly admits that the father's name of the present applicant is mentioned in the complaint. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. The instant application is dismissed as not pressed with liberty to file appropriate application/bail application/Anticipatory Bail Application/proceedings before the court of competent jurisdiction.
