Heard the learned counsel for the petitioner and the learned AGA representing the respondents/State. - 3 - HC-KAR NC: 2025:KHC-D:8984 WP No. 104794 of 2025 2. The petitioner is a society running Pre University College from 2019 without grant in aid. He contends that the college has fulfilled all the requisites with all infrastructure, buildings, labs, having more than 800 students for the year 2025-2026. 3. This being the facts of the case, respondent No.2 arbitrarily cancelled permission of the petitioner’s college on vague and flimsy grounds against which the petitioner approached this Court in Writ Petition No.103428/2025 which came to be disposed of directing the petitioner to approach the appellate authority. The petitioner in compliance approached the appellate authority by filing a revision petition under Section 131 of the Karnataka Education Act, 1983 (hereinafter referred to as ‘the Act’, for short). During the pendency of the proceedings before the appellate authority, an interim order came to be passed in favour of the petitioner directing the respondents to open the Students Achievement Tracking System (hereinafter referred to as ‘the SATS’, for short). - 4 - HC-KAR NC: 2025:KHC-D:8984 WP No. 104794 of 2025 4. It is the grievance of the petitioner that despite interim order granted, the respondents have not opened the SATS portal to enable the petitioner and the students to access the details and fill in the data of each of the students. Hence, he is before this Court. 5. Learned AGA submits that the petitioner- institution has been de-recognized for certain deficiencies and draw backs for non-fulfillment of requirements as per the Act and basic amenities not being provided. 6. However, the same is questioned before the appellate authority. In the meanwhile, an interim order was passed to open the SATS portal by the appellate authority, despite which the SATS portal was not opened. Under the circumstances, it becomes necessary for the respondents to open the SATS portal to enable the students to access the SATS portal and so also for the college to feed-in the data of the students. The out come of the appeal would decide the fate of the petitioner’s college. If the petitioner is able to succeed before the appellate authority it would be good for - 5 - HC-KAR NC: 2025:KHC-D:8984 WP No. 104794 of 2025 the students, as they will benefit and will not lose any academic year. If not, it would be a chaotic situation for the unfortunate students who have put their faith and trust on the petitioner college. The consequences may follow which the petitioner will have to meet if such a situation arises. This Court has not expressed any opinion on the merits of the matter. 7. Accordingly, this petition is disposed of directing respondent Nos.2 to 4 to open the SATS Portal of the petitioner’s PU college for the academic year 2025-26 within two days.
