This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Complaint Case No. 135 of 2017, under Sections 323, 506, 427 IPC, Police Station Holagarh, District Prayagraj, pending in the Court of Judicial Magistrate-III, Allahabad expeditiously within a stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It appears from the perusal of the record that above complaint case is pending at the stage of recording of evidence under Section 244 CrPC but since the applicant himself remained absent on many dates and the accused too, no evidence could be adduced under Section 244 CrPC by the present applicant. Hence, the applicant / complainant is directed to appear before the Court concerned on the next date fixed i.e. 3.6.2025 for recording his evidence under Section 244 CrPC and if the said statement is recorded, the trial court is directed to make all endeavours to decide the case expeditiously, if there is no legal impediment. 4.
