HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1919/2025 1. Rajmal S/o Siyaram, Aged About 19 Years, 2. Sulendra S/o Miyaram, Aged About 23 Years, both are R/o Bhoori Pahari, Police Station Kundera, District Sawai Madhopur (Rajasthan) (At Present Confined In District Jail, Sawai Madhopur) ----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Ankit Khandelwal For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 27/02/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 33/2025 registered at Police Station Mantown, District Sawaimadhopur for the offence under Sections 318(4), 319(2) 316(2), 336(3), 338, 340(2) of BNS and Section 66-D of IT Act and Section 13 of the Rajasthan Public Gambling Ordinance, 1949. Learned counsel for the petitioners submits that the accused petitioners have falsely been implicated in this case. Counsel further submits that offences alleged to have been committed by the petitioners are triable by Magistrate. The accused-petitioners are in custody since and the trial of the case may take (2 of 2) [CRLMB-1919/2025] considerable time, therefore, the petitioners may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail application. Considering the arguments advanced by the counsel for the parties and looking to the fact that the case of the petitioners are triable by Magistrate, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioners on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners Rajmal S/o Siyaram,Sulendra S/o Miyaram, in connection with FIR No. 33/2025 registered at Police Station Mantown, District Sawaimadhopur shall be enlarged on bail provided each of them furnish personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so.
