MACA. No.1829/2012 2 2025:KER:27035 J U D G M E N T Dated this the 28th day of March, 2025 The 1st respondent in OP(MV). No.327 of 2004 on the file of the Motor Accidents Claims Tribunal, Kottayam is the appellant. The appeal was filed mainly on the ground that there was a finding by the Tribunal that 1st respondent was negligent, which resulted in the accident.
2. When the matter was taken up for arguments, the learned counsel for the appellant invited my attention to a judgment of a learned Single Judge of this Court in MACA No.1455 of 2011 in which, in a connected matter, this court found that the accident occurred due to the negligence of the 1st respondent. In the light of the above finding in MACA No.1455 of 2011, the present appeal will not stand and as such this appeal is dismissed.
