Petitioner has filed Execution Case No. 34 of 2024, which is pending before Commercial Court, Dehradun. By means of this writ petition, petitioner has sought the following relief: - (i) To issue a writ, order, direction to Learned Commercial Court, Dehradun to decide the Execution Case No. 34 of 2024 N.K.G. Infrastructure Vs. State of Uttarakhand and others for recovery of entire awarded amount as expeditiously as possible within the time frame to be fixed by this Hon’ble High Court. 4. Learned State Counsel, on instructions submits that next date fixed before Executing Court is 05.02.2025. 5. Since execution case was filed only in 2024 and the next date fixed is 05.02.2024, therefore, this Court is not inclined to issue any direction as prayed for. 6. Accordingly, the writ petition is dismissed. However, petitioner shall be at liberty to make appropriate prayer before the Executing Court on the next date fixed.
