The petitioner has filed the present petition under Section 482 of B.N.S.S with a prayer to grant anticipatory bail to him in case FIR No.103, dated 03.11.2024, under Sections 115(2), 117(2), 3(5) of B.N.S, Sections 118(1), 118(2) of B.N.S added later on, registered at Police Station Balachaur, District S.B.S Nagar . 2. While granting the concession of interim anticipatory bail by this Court on 22.05.2025, this Court had noticed the following contentions raised by learned counsel for the petitioner:- “Learned counsel for the petitioner contends that in fact, the complainant party was the real aggressor in the present case. In fact, they had caught hold of the petitioner and caused him 12 serious injuries, which is apparent from the M.L.R (Annexure P-2) of the present petitioner. In his self-defence, the petitioner and other accused had also caused injuries to the opposite side. He further contends that the question of aggressor is yet to be decided by the Trial Court, during the course of trial. Learned counsel for HEMLATA 2025.08.22 04:25 I attest to the accuracy and integrity of this document CRM-M-28559-2025 -2- the petitioner further contends that in fact, there was political rivalry in the village and due to the said fact, he has been involved in a false criminal case.” 3. Learned counsel for the petitioner has reiterated the submissions and further submitted that the petitioner has joined the investigation and his custodial interrogation may not be required. 4. On the other hand, learned State counsel, on instructions from ASI Pashwinder Kumar also submits that the petitioner has joined the investigation and is no longer required for further investigation. 5. In view of the above statement made by learned counsel for the parties, the interim order dated 22.05.2025 is made absolute. The petitioner shall continue to join the investigation, as and when called by the Investigating Officer. The petitioner shall also abide by the conditions as specified under Section 482 (2) of B.N.S.S. 6. Pending application(s) stand(s) also disposed of.
