Mr. S. Deka, learned counsel appearing for the petitioner and Mr. B. Sharma,
learned counsel appearing for the Railways submit that the writ petition has become infructuous, in view of the stand taken by the Railways in second paragraph-15 of the affidavit-in-opposition filed by the respondent nos.1 to 4, which states as follows :
“That with regard to the statements made in paragraph 18 of the writ petition under reply, the answering deponent states that the contractor has been debarred for remaining period as mentioned in the sub clause of Clause 16 (4) in accordance of the provisions of the tender document which has been duly signed by the contractor and the respondent No. 4. However, the debarment along with termination letter dated 14.01.2020 was stayed by this Hon'ble Court.“
In view of the submission made by the counsels for the parties, the writ petition is closed as infructuous.
