By its Public Prosecutor, High Court of A.P., Amaravati, Through Station House Officer K.D.Peta Police Station. ...RESPONDENT/COMPLAINANT This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A.3, seeking 2 regular bail, in Crime No.113 of 2024 of K.D.Peta Police Station, Anakapalli District. 2. A case has been registered against the petitioner herein and others for the offence punishable under Section 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Case of the prosecution, in brief, is that on 04.10.2024, at about 8.00 am, on credible information about illegal transportation of Ganja, the Sub- Inspector of Police, K.D.Peta Police Station, along with his staff and mediators, proceeded to Alluripark and while conducting vehicle checking, three male persons and one female persons disembarked from an auto coming from Sarabannapalem Village and tried to escape from that place. Immediately, the police arrested A.2 to A.5 and seized 181 Kgs. of Ganja from their possession, but A.1 escaped therefrom. The contraband along with vehicle and other material was seized under cover of Mediators’ report and a case has been registered against the accused. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that 181 Kgs. of Ganja was seized from the possession of the accused, which is a commercial quantity. It is submitted by the learned Assistant Public Prosecutor that the investigation is not yet completed and that A.1 is yet to be apprehended. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/A.3. 3 6.
