This petition has been filed by the petitioner seeking a direction for removal of encroachment purportedly made by respondent Nos. 5 and 6 over the Plot No. 97 recorded as Kabristan situated in Village- Handia, Post and Tehsil - Handia, District- Prayagraj. 2. Submissions have been made that the respondent Nos. 5 and 6 have encroached over the land recorded as Kabristan and therefore, the respondents be directed to remove the said encroachment. 3. A perusal of the record indicates that apparently a suit filed by one Mohd. Jahir is pending since the year 2015 pertaining to the land in question and another PIL filed by one Mohd. Hafeez Idrshee being Public Interest Litigation No. 1981 of 2023 has been dismissed on 29.11.2024. 4. Filing of repeated petitions in the nature of public interest litigation despite the pendency of the suit pertaining to the same land in question cannot be countenanced. 5. The petition, purportedly filed in public interest, cannot be entertained, the same is therefore dismissed.
