Neutral Citation No. - 2025:AHC:90406 Court No. - 33 Case :- WRIT - C No. - 17337 of 2025 Petitioner :- Aravind Yadav Respondent :- State of U.P. and Another Counsel for Petitioner :- Rajeev Upadhyay,Shiv Bahadur Singh Counsel for Respondent :- C.S.C. Hon'ble Prakash Padia,J.
1. Order dated 30.04.2025 passed by the respondent no.2-District Magistrate, Farrukhabad by which the financial and administrative power of the petitioner has been seized, is under challenge in the present writ petition. 2.Facts in brief are that on the complaint made against the petitioner, show cause notice dated 04.04.2025 was served upon him and since no reply was given by the petitioner, taking into
consideration the allegations made in the show cause notice, order impugned has been passed. 3.It is argued by the learned counsel for the petitioner that reply to the aforesaid show cause notice was duly submitted by the petitioner on 09.04.2025, copy of which is appended as Annexure- 3 to the writ petition, but the same was not taken into
consideration. It is further argued in para no. 15 of the writ petition that impugned order has been passed without considering the reply submitted by the petitioner.
4. Heard learned counsel for the petitioner, learned Standing Counsel appearing on behalf of the State-respondents and perused the record.
5. From the perusal of order impugned, it is clear that on the basis of complaint made against the petitioner, show cause notice was issued to him and since no reply was given by the petitioner, ex- parte order has been passed against the petitioner.
6. From the perusal of the averments as contained in para nos. 15 and 16 of the writ petition, this Court is of the prima facie opinion that order impugned has been passed without considering the reply submitted by the petitioner on 09.04.2025.
7. In this view of the matter, the present writ petition is disposed of, directing the respondent no.2-District Magistrate, Farrukhabad to pass appropriate order strictly in accordance with law after taking into consideration the reply submitted by the petitioner on 09.04.2025, expeditiously, preferably within a period of three weeks from the date of presentation of a certified copy of this
order.
8. The impugned order will be subject matter of final decision taken by the respondent No.2/District Magistrate, Farrukhabad.
