Order No.02 Dated- 25-02-2025
Heard the parties.
Apprehending his arrest, the petitioner has moved this Court for grant of privileges of anticipatory bail in connection with Kunda P.S. Case No.23 of 2023 registered under Sections 15, 18, 20, 22, 25 (a), 27 (a), 29, 30 of the Narcotic Drugs and Psychotropic Substances Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was dealing in the business of opium and he finances cultivation of opium/poppy seeds. It is submitted that the allegation against the petitioner is false. It is next submitted that 22.75 kg of Poppy Straw and 2.550 kg of opium was seized from the co-accused persons, who disclosed the name of the petitioner to be the person who is a big businessman running business of cultivation and sale of opium. It is further submitted that the petitioner is not named in the F.I.R. It is next submitted that the petitioner has got nothing to do with the present case. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail.
Learned Spl. P.P appearing for the State on the other hand vehemently opposes the prayer for grant of anticipatory bail and submits that keeping in view the direct allegation against the petitioner of being a big businessman of Narcotic Drugs who finances cultivation of poppy and in view of recovery of huge amount of Narcotic Drugs from the co-accused person who have stated about the involvement of the petitioner in the cultivation and sale of Narcotic Drugs, the custodial interrogation of the petitioner is required
during the investigation of the case to find out the chain of the network of Narcotic Drugs and other details of the business of Narcotic Drugs. It is therefore submitted that the petitioner ought not to be given the privileges of anticipatory bail.
Considering the serious nature of allegation against the petitioner as well as the requirement of his custodial interrogation during the investigation of the case, this Court is of the considered view that this is not a fit case where the above-named petitioner be given the privileges of anticipatory bail. Accordingly, the prayer for grant of privileges of anticipatory bail of the above-named petitioner is rejected.
