HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1918/2025 Hanuman Sahay S/o Late Shri Harsahay Sharma, Aged About 53 Years, R/o Sani Mandir Ke Pass, Jamwaramgarh Road Kasba Aandhi, Police Station Aandhi, District Jaipur. (At Present Confined At Central Jail Jaipur) ----Petitioner Versus State Of Rajasthan, Through Public Prosecutor. ----Respondent For Petitioner(s) : Mr. Manish Kumar Meena For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 27/02/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 14/2025 registered at Police Station Aandhi, District Jaipur Rural for the offence under Sections 8/15 and 8/20 of NDPS Act. Learned counsel for the petitioner submits that the accused petitioner has falsely been implicated in this case. It is contended that recovered quantity of poppystraw and ganja is below commercial quantity and recovery was effected from open place and not at the instance of present accused petitioner. The accused-petitioner is in custody since 20.01.2025 and the trial of the case may take considerable time, therefore, the petitioner may be enlarged on bail. (2 of 2) [CRLMB-1918/2025] Per contra, learned Public Prosecutor opposes the grant of bail application and contended that petitioner is a habitual offender and against him several cases of NDPS Act are registered, therefore bail application of accused-petitioner may be dismissed. Heard and perused the material available on the record. Considering the arguments advanced by the counsel for the parties and looking to the fact that recovered quantity of poppystraw and ganja is below commercial quantity. Accused- petitioner is in custody since long and trial of the case will take considerable time, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Hanuman Sahay S/o Late Shri Harsahay Sharma, in connection with FIR No. 14/2025 registered at Police Station Aandhi, District Jaipur Rural shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
