By its Public Prosecutor, High Court of A.P., Officer A.Annavaram Police ...RESPONDENT/COMPLAINANT 2 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A.3 & A.4, seeking regular bail, in Crime No.32 of 2024 of Annavaram Police Station, Alluri Sitharama Raju District. 2. A case has been registered against the petitioners herein and others for the offence punishable under Section 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Case of the prosecution, in brief, is that on 31.08.2024, at about 4.00 p.m., on credible information about illegal transportation of ganja, the Sub-Inspector of Police, Annavaram Police Station, along with his staff and mediators, proceeded to the outskirts of Ittukubeddalu Village and found A.1 and A.2 with white gunny bags. Immediately, the police arrested them and seized 370.7 Kgs. of Ganja from their possession. The contraband along with other material was seized under cover of Mediators’ report. Initially a case has been registered against A.1 & A.2 and later the petitioners herein were arrayed as A3 & A.4 along with other accused/A.5 to A.8. The petitioners herein/A.3 & A.4 were arrested on 31.08.2024 and remanded to judicial custody. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that 370.7 Kgs. of ganja was seized from the possession of the accused, which is a commercial 3 quantity. It is submitted by the learned Assistant Public Prosecutor that the investigation is not yet completed and that A.2, A.7 & A.8 are yet to be apprehended. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/A.3. 6.
