Heard Sri Rakesh Tripathi I, learned counsel for the applicant and Sri Sunil Kumar Mishra, learned counsel for the opposite party. At the very outset, Sri Sunil Kumar Mishra, learned counsel for the opposite party submitted that pursuant to the order of this Court dated 9.12.2024 passed in Writ-A No. 16807 of 2024, no recovery has been made from the applicant rather respondent authorities has passed an order dated 11.12.2024 staying the recovery order, therefore, no contempt is made out and same is liable to be dismissed. Sri Rakesh Tripathi I, learned counsel for the applicant pointed out that after staying the recovery, no payment has been made to the applicant, therefore, it is violation of order of this Court dated 9.12.2024 passed in Writ-A No. 16807 of 2024. I have considered the rival submissions advanced by the learned counsel for the parties and perused the record as well a order of this Court dated 9.12.2024 passed in Writ-A No. 16807 of 2024. From perusal of the same, it is apparently clear that recovery order has been stayed, but there is no order of payment, therefore, under such facts and circumstances, there is no wilful disobedience of the
order of the writ Court and same is liable to be dismissed. Accordingly, the contempt application fails and is hereby dismissed. No order as to costs.
