ORAL ORDER (PER: THE HON'BLE MR JUSTICE ANANT RAMANATH HEGDE)
1. Heard learned counsel appearing for the petitioner.
2. Learned Additional Government Advocate accepts notice on behalf of respondents No.1 to 5 and 7.
3. The petitioner is assailing the
order dated 02.04.2025 passed by respondent No.2-Deputy Commissioner, Koppal marked at Annexure-H, wherein respondent No.2-Deputy Commissioner, Koppal has passed an order to enter the name of respondent No.6 in the property records based on the registered sale deed in the name of respondent No.6.

Learned counsel for the petitioner submits that respondent No.6 was minor and the property was sold, as such, the sale transaction executed by his father is void.

5. The Revenue Court cannot get into the legality of the registered sale deed i.e., the settled position of law. It is also noticed that the sale deed is said to be in favour of the minor. Whether he was minor or major at the time of sale deed, is a question of fact which is to be adjudicated in a Civil Suit by the competent Civil Court.
6. Under these circumstances, without expressing anything on the merits or demerits of the impugned orders by the revenue authorities, the writ petition is not entertained.
7. Hence, the following:
ORDER i. Writ petition is dismissed. ii. Liberty is reserved to the petitioner to approach the competent Civil Court to establish his claim.

iii. It is made clear that observations made here should not be construed as having reflected on the merits or demerits of the claim of either of the parties. iv. Since this order is passed without notice to respondent No.6, liberty is reserved to respondent No.6 to seek modification of the order.
