For Appellant(s): Mr. K.N.Nataraaj For Respondent(s): Mr.K.M.D. Muhilan, APP ORDER This Writ Petition has been filed by the petitioner seeking for issuance of Writ of Mandamus or any other writ or direction or order in the nature of writ of mandamus directing the 3rd respondent to register an FIR based on the complaint of the petitioners dated 13/01/2025 and initiate an investigation into the fraudulent deposit scheme. 2. It is the grievance of the petitioners that they have invested their hard https://www.mhc.tn.gov.in/judis WP Crl. No. 288 of 2025 earned monies with the respondents 5 to 7 who promised them fanciful returns and thereafter the respondents 5 to 7 have failed to return their monies. Hence, they filed the present writ petition seeking to quash an FIR based on the complaint of the petitioners dated 13/01/2025 and initiate an investigation into the fraudulent deposit scheme. 3. When the matter is taken up for hearing, the learned Addl. Public Prosecutor appearing for the respondents 1 to 4 submitted that already on a complaint filed by the depositors against the same accused persons, the prosecution has launched an FIR in Crime No.214 of 2024 against the respondents 3 to 5 for the offences under sections 120B and 420 of IPC and Section 5 of Tamilnadu Protection of Interest of Depositors (In Financial Establishment) Act 1997. 4. As the FIR has already been registered based on the complaints given by the depositors who deposited their monies in fraudulent deposit scheme, the police cannot register separate FIRs for each and every complaint.
