The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.153/2023 registered at Police Station-Amer, District-Jaipur City (North) for the offences under Sections 302, 201 and 120B of IPC. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner respectfully submits that the petitioner has falsely been implicated in the present case. It is contended that there are no eyewitnesses to the incident in question. Furthermore, the material witnesses have already been examined during the course of the trial. Notably, prosecution [2025:RJ-JP:21774] (2 of 2) [CRLMB-1913/2025] witnesses 4 and 5 (PW4 and PW5) have not supported the case of the prosecution and have turned hostile. It is further submitted that the remaining witnesses have not deposed anything incriminating against the petitioner. Co-accused-Kailash has been enlarged on bail by the trial Court itself. Petitioner is behind the bars since 18.03.2023. The trial of the case may take considerable time, hence the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the PW4 and PW5 have supported the story of prosecution. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case including material witnesses have turned hostile, custody period and co-accused has been enlarged on bail by trial Court itself but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner-Raju S/o Late Shri Ratan Singh shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for his appearance before that Court on all the dates till conclusion of the trial.
