1. Applicant seeks regular bail in case arising out of FIR No.0031/2024 dated 03.04.2024, registered at P.S. Cyber Police Station South for commission of offences under Sections 420/120B IPC. 2. Admittedly, at one earlier point of time, there was a settlement agreement between the accused and the complainant and in terms of said agreement, the accused had made part payment of Rs.10,00,000/- to the complainant and with respect to the balance payment, three cheques were issued. These cheques were signed by his father but when presented these returned dishonoured. For the abovesaid dishonourment of the cheques, the complainant has already filed three separate complaints against the father of the accused. 3. counsel for the applicant, on instructions from them and as per the discussion which he had with the accused yesterday in a meeting at Central Jail, Tihar submits that the applicant is ready to make the payment of the balance amount in three equal installments as under:- a. Rs.5,00,000/- to be paid on or before 31.01.2027. b. Rs.5,00,000/- to be paid on or before 30.06.2027 c. The balance amount of Rs.6,74,606/- on or before 30.11.2027. 4. He submits that in case there is any violation in payment of the abovesaid installment, the complainant and the prosecution would be at liberty to seek cancellation of the bail. 5. The next date before the learned Trial Court is stated to be 21.09.2026 and it is undertaken that a sworn affidavit with respect to the abovesaid settlement shall be filed by the applicant before the learned Trial Court. 6. The complaint in question was lodged by the respondent No.2 i.e. Mr.
Chitaranjan Ray as he reported to the police that he was defrauded of Rs.26,74,606/- on the pretext of investment in share market. 7. Complainant is present in Court. 8. The investigational aspects are already over and as far as present applicant is concerned, the Nominal Roll is already on record which indicates that he was arrested on 17.03.2025 and his period of incarceration is already well above one year. 9. The case is at the stage of consideration of charges. 10. Keeping in mind the incarceration period, the clean antecedents of the applicant, the previous settlement and the fact that the applicant has now undertaken to make the entire payment to the complainant, which terms are also acceptable to the complainant for the purposes of grant of bail, the This is a digitally signed order. applicant is, hereby, directed to be released on bail on his furnishing personal bond in a sum of Rs.50,000/- with one surety of like amount, subject to satisfaction of learned Trial Court/CMM/Duty Magistrate with the following conditions:- a. Surety would be local. b. Applicant shall appear before the learned Trial Court regularly on date(s) fixed. c. Applicant/accused shall provide his mobile number to the investigating officer and shall keep the same operational all the time, till the disposal of the case. d. Applicant shall not leave NCT of Delhi without prior permission of learned Trial Court. e. Applicant shall not try to contact any of the prosecution witnesses. f. Once the payment is made as per the abovesaid terms of settlement, proof of such payment shall also be filed by the concerned applicant before the learned Trial Court. 11. The application stands disposed of in aforesaid terms. 12. A copy of this order be sent to the learned Trial Court and also to the Jail Superintendent for necessary information and compliance.
